The California State Bar has formed the Malpractice Insurance Working Group (MIWG) to study several legal malpractice issues to “protect the public.”
The California State Bar Board of Trustees is considering:
1 — Mandating Legal Malpractice Insurance for attorneys as a condition of licensing, except for in-house counsel and government attorneys.
2 — Establishing a Captive Fund run by the State Bar, a private insurance company, or an entity created expressly for this purpose.
